Acceptance of Terms

By downloading, installing, or using Vidgest, you agree to these Terms of Service. If you do not agree, do not use the app.

Description of Service

Vidgest is an independent macOS application that accesses publicly available video captions and provides AI-powered analysis. Vidgest is not affiliated with, endorsed by, or sponsored by any video platform or AI provider. AI features are available via the free tier (Vidgest servers), Pro subscription, or Max license.

User Responsibilities

You are responsible for: (1) ensuring your use of transcripts complies with applicable terms of service of the video platform and respects the intellectual property rights of content creators, (2) using transcripts and AI-generated analyses for personal, non-commercial purposes unless you have obtained appropriate rights, (3) if using Max, providing your own AI API keys, managing associated costs, and maintaining the security of your API keys.

Prohibited Uses

You agree not to: (1) use automated scripts, bots, or other tools to access Vidgest or its services programmatically, (2) systematically download or scrape content beyond normal personal use, (3) attempt to circumvent, disable, or interfere with rate limits, usage restrictions, or security features, (4) use the app in any manner that could damage, disable, or impair the service or interfere with other users' experience, (5) redistribute, sublicense, or resell access to Vidgest or its features.

User Content

You represent and warrant that you have all necessary rights, licenses, and permissions to process any audio, video, or text content through Vidgest. When you import local audio or video files for transcription, you are solely responsible for ensuring compliance with applicable laws, including recording consent laws in your jurisdiction. Vidgest processes files you provide — it does not record, capture, or intercept any communications. The developer is not responsible for any claims arising from content you submit for processing.

AI Services

Vidgest provides AI analysis through two paths: (1) Free/Pro tier: Vidgest servers process your request via Google Gemini. Free users receive 3 analyses per day; Pro subscribers receive 500 per month. We reserve the right to modify limits or discontinue the free tier with reasonable notice to users. (2) Max: Your API keys connect directly to Google Gemini, Anthropic Claude, or OpenAI. You are subject to those services' terms and responsible for any charges. In both cases, Vidgest does not guarantee the accuracy, completeness, or reliability of AI-generated content.

Purchases

Vidgest offers three purchase options processed through the Apple App Store: (1) Pro Monthly ($4.99/month) and Pro Annual ($34.99/year) auto-renewable subscriptions with a 7-day free trial, providing 500 AI analyses per month, all export formats, and Whisper transcription. (2) Max ($49.99 one-time) non-consumable purchase for AI with your own API keys and no app-imposed limits. Subscriptions auto-renew unless cancelled 24 hours before the end of the current period. Manage subscriptions in System Settings. Refund requests must be directed to Apple.

Intellectual Property

Vidgest and its original content, features, and functionality are owned by the developer. Video transcripts remain the intellectual property of their respective content creators. Vidgest provides tools to access and analyze these transcripts for your personal use — it does not claim ownership of any third-party content. All third-party service names and trademarks are the property of their respective owners. Vidgest is not affiliated with or endorsed by any third-party service.

Transcript Availability

Vidgest accesses publicly available caption data from video platforms. Transcript availability depends on the video having captions enabled by its creator or auto-generated by the platform. Vidgest does not download, stream, or cache any video or audio content. Transcript access is subject to the video platform's systems and may be unavailable for some videos at any time. Platform changes may affect transcript availability without notice.

Service Availability

Vidgest relies on third-party services (e.g., video platforms, AI providers) to provide its functionality. We do not guarantee uninterrupted, timely, or error-free service. The app may be temporarily unavailable due to maintenance, updates, third-party service outages, or circumstances beyond our control. Third-party providers may modify, rate-limit, or discontinue their services at any time, which may affect Vidgest functionality without prior notice. The developer is not responsible for any loss or inconvenience caused by service interruptions from third-party providers.

Limitation of Liability

Vidgest is provided "as is" without warranty of any kind. The developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the app. The developer is not responsible for the availability, accuracy, or performance of third-party services that Vidgest relies on, including video platforms and AI providers.

Data and Privacy

All data is stored locally on your device. Please refer to our Privacy Policy for complete details on data handling.

Modifications

We reserve the right to modify these terms at any time. Changes will be included in app updates. Continued use after updates constitutes acceptance of the revised terms.

Termination

You may stop using Vidgest at any time by uninstalling the app. We reserve the right to terminate or restrict access to the app for violations of these terms.

Indemnification

You agree to indemnify, defend, and hold harmless the developer from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or related to your use of the app, your violation of these Terms, or your infringement of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of Vidgest shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts located in Orange County, Florida.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
